Royalty Advice
(Re-post from Myspace)
Last month, I chose not to renew my contract with an epublisher I’d worked with. I was unhappy with the lack of contact from the company in regards to questions – I would only receive responses to my queries (of which there were damn few, let me tell ya) if I posted them to their chat list, or cc’d other parties (such as my darlin’ Louise).
So, it took two weeks for a finalization on my release from contract. I was told I’d have the final royalty statement to that date (late October) within a couple of days. A week or so ago, I received it, finally, but only until the end of September. I re-sent the publisher/owner my paypal information – AGAIN which makes 4 times in total – and haven’t heard a thing since.
There is at least two weeks of possible sales unaccounted for. Not to mention that I believe there were more sales at Fictionwise than are listed, although my jump from 70-something to under 20 in the rankings might have been something other than sales.
I have been told before though, that you move UP the list, as you sell.
Short of weekly or daily emails to this woman, and contacting a lawyer for what will likely amount to under $100 – any thoughts?
Please feel free to kick my ass for not researching this company a little more. The woman in charge is also a part of several other e-pubs. All erotica, from what I can see. :-/ I feel like an r-tard.

Well, I’m not going to beat you up over it…looks like you’re doing that well enough on your own.
I think I’d advise against a lawyer unless you think you can get damages out of them somehow. If all you want is the royalty payments, the legal bills would swallow that and then some (unless you’ve got a really close friend or family member who’s a lawyer who’d go after them for free).
As much of a pain as it is, you may be stuck with personally hounding them until they cough it up.
Thanks Jeff! ((((hugs))))
She finally coughed up with the payment that was on the statement, but I am still wondering about the Fictionwise sales. I mean, I’ve had it explained to me by several people ‘in the know’, and they all tell me the rankings for bestseller *are* done on sales. But, they couldn’t tell me if one sale moves you up one spot or not, since it’s all relative.
I’m going to have to settle for what I’ve got, and just be glad it’s all done with now.
